Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all users of the Berengario hosted service. It forms part of the Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.

1. Prohibited Content

You must not upload, transmit, or store content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, or fraudulent.
  • Infringes any intellectual property rights, including copyright, trademarks, or trade secrets.
  • Contains malware, viruses, or any other harmful or disruptive code.
  • Contains child sexual abuse material or promotes the exploitation of minors.
  • Promotes violence, terrorism, or hatred against individuals or groups.
  • Violates the privacy or data protection rights of any third party.

2. Data Type Restrictions

The Service is designed for organisational knowledge management. You must not use the Service to process:

  • Special category data (as defined in UK GDPR Article 9) — including racial or ethnic origin, political opinions, religious beliefs, trade union membership, genetic data, biometric data, health data, or data concerning sex life or sexual orientation — unless you have obtained explicit consent from the data subjects and have a lawful basis for processing.
  • Criminal offence data (as defined in UK GDPR Article 10) without appropriate legal authority.
  • Payment card data (PCI DSS scope) — credit/debit card numbers, CVVs, or cardholder authentication data.
  • Credentials or secrets — passwords, API keys, private keys, or access tokens.

If your use case requires processing special category data, please contact us to discuss appropriate safeguards.

3. System Abuse

You must not:

  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Attempt to gain unauthorised access to other Accounts, systems, or networks connected to the Service.
  • Use automated tools to scrape, crawl, or extract data from the Service beyond normal API usage.
  • Deliberately overload, disrupt, or degrade the performance of the Service.
  • Circumvent any usage limits, rate limits, or access controls.
  • Use the Service to develop a competing product or service.
  • Probe, scan, or test the vulnerability of the Service without prior written consent.

4. Email Use

The Service includes email integration (IMAP inbox monitoring and SMTP reply sending). You must not:

  • Use the Service to send unsolicited bulk email (spam).
  • Configure the Service with IMAP credentials you are not authorised to use.
  • Use the Service to harvest, collect, or store email addresses for purposes unrelated to the Service.
  • Impersonate other individuals or organisations through the Service's email functionality.
  • Use the Service to relay, forward, or redistribute email in violation of any applicable anti-spam legislation.

5. Compliance Obligations

You are responsible for:

  • Ensuring you have the legal right to upload and process all content you provide to the Service.
  • Obtaining any necessary consents from individuals whose personal data may be included in your documents or emails.
  • Complying with all applicable laws and regulations in your jurisdiction, including data protection, intellectual property, and export control laws.
  • Maintaining appropriate access controls within your organisation for your Berengario Account (e.g., whitelist management).
  • Promptly notifying us if you become aware of any unauthorised use of your Account.

6. Enforcement

We reserve the right to investigate suspected violations of this AUP. If we determine that a violation has occurred, we may take action including:

  • Warning — notifying you of the violation and requesting remediation.
  • Content removal — removing or disabling access to content that violates this AUP.
  • Suspension — temporarily suspending your Account while we investigate.
  • Termination — permanently terminating your Account for serious or repeated violations.

Where possible, we will provide notice before taking action and give you an opportunity to resolve the issue. However, we may act immediately and without notice where we reasonably believe there is an imminent risk of harm, legal liability, or damage to the Service or other users.

Termination for AUP violations does not entitle you to a refund of any prepaid fees.

7. Reporting Violations

If you become aware of any violation of this AUP, please report it to support@berengar.io.

8. Changes to This Policy

We may update this AUP from time to time. We will notify you of material changes by email at least 30 days before they take effect. The "Last updated" date at the top of this page indicates when the policy was last revised.
